The Facts
On October 25th, 2017, Winston was stopped in his vehicle and waiting to merge into traffic on the Long Island Expressway (I-495) near the Junction Blvd exit in Queens, New York. While he was waiting to safely merge, a large commercial truck further behind Winston was also attempting to merge. The commercial truck driver looked over his shoulder to see if he had space to merge while driving and upon looking forward again, he was unable to safely stop before rear-ending a van that was pushed forward into the rear of Winson’s car! He remembered violently striking his head on the headrest. Winston was taken by ambulance to Elmhurst Hospital Center for evaluation and was discharged home.
As a result of the accident, Winston suffered injuries to both knees, neck, left shoulder and back. He sustained multiple cervical/lumbar disc herniations and bulging discs which made him feel constant pain in his neck and lower back. He was required to undergo pain management injections to his lumbar spine and left shoulder. Winton’s left knee meniscus tear did require surgery on February 22nd, 2019, and he also suffered a meniscus tear, MCL tear, and LCL tear to his right knee. He was confined to his bed for approximately six weeks.
