The Facts
On August 6th, 2020, Martine was walking in the crosswalk at the intersection of East Fordham Road and West Morris Avenue, in the Bronx when a distracted driver struck her on her right side! She stated that the driver was using her phone and was not paying attention to the road.
As a result of the pedestrian accident, Martine – who used to work as a companion caregiver – was immediately taken to the St. Barnabas Hospital where she was admitted before the police came in to take her statement. Martine was in a significant amount of pain in her right leg and was diagnosed with a fractured knee.
Thereafter, Martine began a course of physical therapy and orthopedic care which continues to date. Unfortunately she may require knee replacement surgery — also known as knee arthroplasty — to help her relieve the pain caused by the accident and restore function in her severely damaged knee joints.
To add “insult to injury”, the vehicle that struck Martine was uninsured as the driver failed to pay her insurance premiums. Fortunately, the New York State Department of Financial Services created the Motor Vehicle Accident Indemnification Corporation (MVAIC). This non-profit organization serves as a last resort when a pedestrian is either struck by a hit-and-run vehicle and/or an uninsured vehicle. MVAIC steps into the shoes of the uninsured vehicle and will pay medical bills, loss of income and compensate the accident victim for their pain and suffering.
Only a few months after the accident, and thanks to the diligent work of our personal injury team at PPID, Martine recovered a lump sum settlement. In addition, all her medical bills and lost wages have been paid.
