What Happened?
On December 4th, 2019, Wade was sitting in his parked car near East Gun Hill Road and White Plains Road when it was suddenly rear-ended by another car. The police never arrived at the accident scene, but, thankfully, the ambulance arrived and transported Wade to Montefiore Hospital. The police finally showed up at the hospital to get Wade’s statement and he later discovered that the driver of the other vehicle told the police that Wade was actually backing out of a driveway when both vehicles collided.
As a result of the accident, Wade injured his neck and back. His injuries made it difficult to do household chores and regular activities such as turning his neck, sitting, bending, lifting, carrying, and reaching. Wade was unable to go back to work as a construction worker for several months since his pain made it hard to tolerate working. It wasn’t until 9 months after the accident that Wade returned to work in a reduced capacity. He attended months of physical therapy and participated in home exercises.
Thanks to a friend’s recommendation, Wade contacted The Case Handler team! Since the other driver lied to the police about the accident, their insurance company denied liability and refused to give Wade anything. So what did we do next? We had to file suit and motions to show them that we meant business for Wade’s bodily injury claim. In the end, our experienced Bronx parked car accident lawyer at Pollack, Pollack, Isaac & DeCicco, LLP successfully recovered his lost wages, the maximum policy limits of $25,000.00 from the insurance company, and an additional $37,500.00 underinsured motorist (SUM) coverage to help get Wade even more money in his pocket!
