What Happened?
On May 5th, 2020, Michelle was driving on the Major Deegan Expressway in the Bronx. While driving about 50 mph, she noticed a speeding BMW quickly approaching and sped past her. Soon after the vehicle passed, she was suddenly rear-ended by a different vehicle that was apparently drag racing the first car! Michelle remembers hitting her head on the steering wheel, and the car spinning out of control. When her car stopped, she was facing oncoming traffic! After the ambulance arrived, she was evaluated on-site and recommended to go home due to the coronavirus outbreak. Michelle went home but felt so much pain the next morning that she went to the Montefiore Medical Center Emergency Room.
As a result of the accident, Michelle suffered a head contusion and left shoulder injury (full thickness rotator cuff tear at the distal insertion of the supraspinatus tendon). She initially thought she would be able to return to work, but she could not lift anything heavier than 10-15 pounds without significant pain. Michelle had trouble reaching, pushing, pulling and performing normal daily activities. She couldn’t even do her own hair because she could not lift her arm above the shoulder level! She attended therapy for several weeks and when conservative treatment failed to improve her shoulder, Michelle underwent left shoulder surgery on August 14, 2020.
After her accident, Michelle asked her friend if she had a lawyer she would recommend and her friend told her to contact Adam Handler! The defendant’s insurance, GEICO, initially offered only $45,000 to settle her case. With the help of our talented Bronx Expressway accident attorneys at Pollack, Pollack, Isaac & DeCicco, LLP and the quality of evidence we were able to provide, we recovered in less than one year a $235,400.90 judges award!
