What Happened?
On May 16, 2017, Mia was in the backseat of a parked car on the left side of East 179th Street with its hazard lights activated. As she was bent down looking for a lost item in her bag, a large passenger van suddenly sideswiped the left rear where Mia was situated. The force of the impact caused Mia to scream and fall inside the car. The van driver later informed the police that they were picking up a passenger and driving off when the vehicle Mia was in “opened the door”, leading to the unavoidable collision. Complicating matters, the police reported that Mia’s vehicle was parked in a “no parking” zone. Following the accident, Mia went to urgent care where she received evaluation, treatment, and was discharged home.
The accident resulted in injuries to her lower back and neck. Mia experienced pain in these areas with radiation into both right and left upper extremities, and with radiation, numbness, and tingling into both right and left lower extremities. Additionally, she had weakness on the right side of her body and rated the severity of her pain on a scale of 1-10, with 10 being the worst, as 10/10 for both back and neck. Activities such as lifting, bending, standing up, sitting, lying down, walking, and sleeping exacerbated her pain. Mia continues to participate in conservative treatment and underwent neck surgery (anterior cervical discectomy fusion at C5-6) under general anesthesia in June 2018. As a result of her injuries, Mia sustained a permanent disability, experiencing persistent restriction of motion, pain, significant numbness, tenderness, and loss of sensation. She has been unable to work since the accident.
